Terms of Use
1. Acceptance of Terms
By accessing or using the sriambika.co.in website ("Site"), you agree to be bound by these Terms. If you do not agree, please do not use the Site. These terms apply to all visitors, customers, and others who access the Site.
2. Intellectual Property
All content on this Site — including text, product descriptions, technical data sheets, images, and the Sri Ambika brand — is the property of Sri Ambika Heat Product & Trading Company and is protected by Indian and international copyright law. You may not reproduce, distribute, or create derivative works without our written permission. Downloading individual data sheets for internal procurement purposes is permitted.
3. Product Information Accuracy
We make every effort to ensure product specifications, dimensions, and ratings shown on this Site are accurate. However, we reserve the right to correct errors without notice. Specifications for manufactured-to-order products are confirmed in the written order acknowledgement, which takes precedence over the website.
4. Limitation of Liability
To the maximum extent permitted by law, Sri Ambika Heat Product & Trading Company shall not be liable for indirect, incidental, or consequential damages arising from the use of or inability to use our products or this website. Our maximum liability is limited to the invoice value of the specific goods that caused the claim.
5. Governing Law & Jurisdiction
These terms are governed by the laws of India. Any dispute arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Faridabad, Haryana, India. Both parties submit to such exclusive jurisdiction and waive any objection to proceedings in those courts.
Payment Terms
6. Standard Payment Terms
100% advance payment is required for first-time orders. For established customers with a credit account, payment is due within 30 days of the invoice date (Net 30) unless otherwise agreed in writing.
7. Accepted Payment Methods
We accept: NEFT / RTGS bank transfer (preferred for domestic orders), UPI, Cheque (for established accounts only — goods dispatched after clearing). For export orders, we accept T/T (telegraphic transfer) and Letter of Credit (LC) at sight, subject to prior agreement.
8. GST / Tax
All prices are exclusive of GST. GST at the applicable rate (currently 18% for heating elements under HSN 8516) will be added to your invoice. Our GSTIN is 06ZNDPS5157P1Z3. Export invoices are zero-rated under GST with applicable documentation.
9. Late Payments
Overdue amounts accrue interest at 2% per month (24% per annum) from the due date. We reserve the right to suspend future orders for accounts with outstanding overdue balances.
10. Export Payment
For international orders, full payment by SWIFT T/T in USD or EUR is required before shipment unless a confirmed irrevocable LC has been provided. Bank charges outside India are to the buyer's account.
Refund & Return Policy
11. No Refund on Custom / Manufactured-to-Order Products
Products manufactured to your specific dimensions, wattage, or configuration cannot be returned for a refund under any circumstances. These are custom manufactured goods produced exclusively to your order and have no resale value to us. Please verify all specifications in the order acknowledgement before confirming production. Errors in specifications provided by the buyer are not grounds for a refund.
12. Standard Catalogue Products
Unused, uninstalled catalogue products in original packaging may be returned within 14 days of delivery for a credit or exchange, subject to a 15% restocking fee. Return freight costs are the buyer's responsibility. No cash refunds on catalogue products — only credit notes applicable to future orders.
13. Warranty Claims — Defective Products
Our products carry a 12-month warranty from date of dispatch against manufacturing defects under normal operating conditions within specified ratings. To make a warranty claim: (a) contact us within the warranty period, (b) return the suspect unit with freight prepaid, (c) allow 5–10 working days for investigation. If a manufacturing defect is confirmed, we will supply a replacement unit free of charge or issue a credit note.
14. What the Warranty Does Not Cover
The warranty does not cover: damage from incorrect installation; operation above rated voltage, wattage, or temperature; incorrect sheath material selection for the media; physical damage in transit (report to carrier within 48 hours of delivery); heaters that have been modified, cut, or spliced after supply.
15. Refund Processing
Approved credits (where applicable) are processed by NEFT to the original payment account within 7 working days of written confirmation of approval. No refund or credit shall be issued without prior written authorisation from Sri Ambika Heat Product & Trading Company.
Shipping & Delivery
16. Dispatch Timelines
Standard products: 3–7 working days after order confirmation and payment receipt. Custom-manufactured products: 7–21 working days depending on specification complexity and order volume. Lead times are confirmed in the order acknowledgement and are estimates, not guarantees.
17. Shipping Terms (Domestic)
Domestic shipments are dispatched Ex-Works Faridabad, Haryana unless freight-inclusive pricing has been agreed in writing. We use reputable surface and air freight carriers. Risk of loss transfers to the buyer upon handover to the carrier.
18. Export Shipments
Export shipments are on FOB Delhi/Nhava Sheva basis unless otherwise agreed. All export documentation (commercial invoice, packing list, certificate of origin, shipping bill) is provided. CIF/CIP terms available on request at additional freight cost.
19. Damages in Transit
Report any visible transit damage to the carrier at the time of delivery and notify us within 48 hours with photographic evidence. We will assist with carrier claims where possible, but liability for transit damage rests with the carrier once goods are handed over.
